Biometric Data Policy and Notice

Purpose

Advisors Excel, LLC (“AE”) has adopted this Biometric Data Policy and Notice (this “Policy”) to govern the treatment of our users’ Biometric Data. Protecting the confidentiality and integrity of Biometric Data is a critical responsibility that must be taken seriously at all times. Compliance with this Policy is mandatory.

 

Scope

This Policy applies to all Company employees, agents, and representatives, including any contractor or third-party service provider to AE (“Third-Party Service Provider”) who has access to Biometric Data on behalf of AE. This Policy applies to all Biometric Data collected, maintained, transmitted, stored, retained, or otherwise used by AE regardless of the media on which that information is stored.

 

Definitions

“Biometric Data” means collectively all Biometric Identifiers and Biometric Information.

“Biometric Identifiers” means:

  • Voiceprints
  • Scans of face geometry

Biometric Identifiers do not include:

  • Writing samples and written signatures
  • Photographs
  • Demographic data
  • Physical descriptions, such as height, weight, hair color or eye color

“Biometric Information” means information, regardless of how it is captured, converted, stored, or shared, that is based on a Biometric Identifier. Biometric Data does not include information derived from items or procedures excluded under the definition of Biometric Identifiers.

Retention Schedule

For current employees, AE will retain biometric information about you for the duration of your employment or contracting relationship with AE.

For all other individuals, AE will securely and permanently destroy the Biometric Data within a reasonable time after the purpose for collecting or obtaining the Biometric Data has been satisfied, after determining during a review that storing the Biometric Data is no longer necessary, or within one year of your last interaction with AE.

In the event of litigation or legal investigation, we may preserve information as required by law. This information will be retained and protected in accordance with legal hold processes.

 

Biometric Data Collection

AE and its providers collect, store, and use voiceprints and face geometry for the purpose of providing enhanced video and audio editing services. Before collecting Biometric Data from any individual, AE will obtain the individual’s written consent to the collection.

 

Withdrawal of Consent
